Seems like it should be legal in my case. The sub work is contracted out. It just happens to also be a part time employee that occasionally bids on them.

I should alter some of my information a bit. I go to work alone. When I get there, I clock in, and then am forced to carpool to the jobsite with 4 other people. We have to go back to the store to clock out for lunch, clock back in an hour later and carpool back to the jobsite. We then have to finish our day and carpool back to the store to clock out for the day.
