can the landlord do construction on our property without our permission, or at least compensation?
SoCalDoc asked:
is it ok for the landlord to paint/renovate the house we live in, (involving nailing/power tools) for over a month (of our 9mo lease)? we are unable to use our patio, often cannot use our parking spots, cannot sleep in, when i am home during the day i have to keep the shades drawn because there are men all over the patio, sometimes knocking on the door asking me to move my car, they leave the gates open and i cannot let the dog out…… should we have rent reduction or some compensation during this? the landlord says he does not have to compensate us because it is “normal maintenance.” seems inappropriate…….
but doesnt our paying rent also give us the right to enjoy peace and privacy, as well as the use of the patio that was a part of the draw? while i am paying to live here does he not give up some of his rights to do whatever he wants on the property?
it seems inappropriate b/c right now i work nights, and during the day the house is unusable to me. i am paying a lot of money for this.
and i do not care if it is painted i am only living here 3 more months. it is a beach front “vacation” rental. some vacation

Sure, the owner of the property has every right to maintain it.
He does not have to compensate you unless the water is off over night. In that case he needs to pay for you to stay at the closest hotel.
I am not sure what seems inappropriate. This is a major investment of his and he has the right to maintain it.
You rent the property but it is YOUR LANDLORDS property you DO NOT own it. The landlord has a right to maintain his property.
GEee Here is a land lord improving his property and the renter is mad because they have to move their car??
He owns the house, and you will reap the benifits of the repairs, and nicer place.
He might be required to do upkeep or repairs by the city, because of zoning laws, and maintenance rules
Consider yourself luck to have a landlord that does something.
Refer to your lease. The lease is the key to your relationship to the landlord. By this document you reside in his property and both of you have your rights. If in doubt consult a real estate attorney.
you can not be mad at the landlord because he wants to do repairs to better the property. I would however, ask the landlord to work with you somehow or let you out of your lease. I would becareful for what you wish, next time you might get a landlord that won’t answer your requests for maintance.
Depends on the lease as it dictates all actions. You have rights as a tenant and those rights are defined in the lease. If it is outside the “normal” realm, then you could have issues and would need to involve a legal professional to give you legal guidelines for your inconvenience. You are paying to live there at a normal rent. ITo get rent concessions made due to noise, inconvenience, lack of use, then I would invite you to make an inquiry to a lawyer.
You have every right to be upset. I don’t think any one that posted an answer on here so far has looked at it from your point of view…they’ve only looked at it from the landlords point of view.
I would be upset if I worked night shift came home to sleep and all day all I heard were power tools, I couldn’t use my patio, couldn’t even let my dog in the back yard and was constantly asked to move my car. Come on now that’s just ridiculous!!!
If it states in your lease that that specific parking spot is your spot then If I were you I would stop moving my car…that’s your spot that your paying for!!! Other then that unfortunately, no matter how unfair it is there is nothing you can do as long as they aren’t starting early in the morning or working way into the night.
